The characters are composites to a certain extent. Lennie was a real person. He’s in an insane asylum in California right now. I worked alongside him for many weeks. He didn’t kill a girl. He killed a ranch foreman. Got sore because the boss had fired his pal and stuck a pitchfork right through his stomach. I hate to tell you how many times. I saw him do it. might account for the paradox: During sentencing, Judge J. Howe Brown stated in court, “Nothing I can do brings back Elijah or makes [his parents] feel better. Likewise, nothing I can do to punish [Fraraccio] is more important than her memory of what she did. . . . The sentence that I’m going to give is not going to satisfy probably anybody, and people may talk about it for a long time.”

Prosecutors had asked for a sentence of fifty years in prison. When Judge Brown read his sentence, gasps swept the courtroom—five years in prison. The Nealeys were shocked. “Not five years. That’s definitely not right.” Jessica Fraraccio cried as Jennifer Nealey spoke in court of the agony of losing her child. The family was shattered and heartbroken by the murder of their innocent child, whom they entrusted for a short time to the care of Fraraccio. Fraraccio said in court, “I don’t know that I’ll ever be able to forgive myself—I really did love Elijah.”
