There are 150 questions on this diagnostic examination, and you should finish the entire examination in 4½ hours. For maximum benefit, it is strongly recommended that you take this examination in one sitting as if it were an actual test.

The answers to this examination and their explanations begin immediately following the examination. By completing the chart in the section “Diagnostic Procedure,” you can get an idea of which question types give you the most difficulty. You can then devote most of your time to those areas.

BEFORE YOU TAKE THE TEST

Before taking this examination, you should have read the Introduction. Be certain that you employ the test-taking strategies recommended earlier while taking this examination.

Remember to read each question and related material carefully before choosing your answers. Select the choice you believe to be the most correct, and mark your answer on the Answer Sheet provided at the beginning of this chapter. NOTE: This diagnostic examination is more difficult than the typical official examination. It is divided into several sections to help you become familiar with various question types and for ease of diagnosing your results, since each section corresponds to a chapter in the book. However, the actual examination will probably not be divided into sections. For this reason, the three practice examinations appearing later in the book are not divided into sections.

REMEMBERING WRITTEN MATERIAL

10-minute time limit

Directions: Answer questions 9 through 15 based on the following narrative. You are permitted 10 minutes to read the narrative and to commit to memory as much about it as you can. You are not permitted to make any written notes during the 10 minutes you are reading the story.

At the end of the 10 minutes, you are to stop reading the material, turn the page, and answer the questions without referring to the written material. This 10 minutes is part of the overall 4½ hours that have been allotted to complete the exam.

Police Officers Long, Carmen, and Levine, while conducting a surveillance on patrol in plainclothes in an unmarked car, witnessed an apparent drug transaction taking place on the street in front of 3105 51st Street, an area known for its drug activity. They observed the defendant, Thomas Smith, in conversation with another male and saw Smith pass his companion a three-by-five-inch brown envelope which appeared to resemble a “twenty dollar bag” commonly used in drug transactions. Officers Long and Carmen exited their vehicle and identified themselves as police officers. The defendant immediately fled and the officers pursued him. As he ran, Smith threw a black object under some bushes. He then stopped running and was apprehended. The black object was recovered from the bushes and was found to be a loaded, operable nine millimeter pistol. The defendant was placed under arrest and the supervisor, Sergeant Hanley, then responded to the scene.

At trial, conducted by Judge Wiser, the defendant sought to have the gun suppressed on the grounds that he was forced to abandon it as the result of illegal police conduct. The defendant contended that neither the passing of a manila envelope nor his immediate flight from the police created reasonable suspicion that he had committed or was about to commit a crime. Thus, he argued that the gun should be suppressed as the “fruit of the poisonous tree.”

The Court rejected the defendant’s arguments and found that the level of police intrusion was an appropriate response to the observations and beliefs of the officers involved. In reaching its decision, the Court used the “balancing test.” Under this test, the legality of police conduct is weighed against all the circumstances and conditions known to the police as the encounter unfolds.

In this case, the Court found that the defendant’s conduct, in passing what appeared to be a “twenty dollar bag” in a neighborhood known for its drug activity, was sufficient to create a suspicion that criminal activity was afoot and to justify the initial approach by the officers. The Court also allowed that the flight of the suspect, when coupled with his prior activity, was sufficient to create a reasonable suspicion that a crime had been committed and to justify a forcible stop. Having found that the initial approach and forcible stop constituted legitimate police conduct, the recovery of the gun discarded during flight was also lawful and, accordingly, the weapon was not suppressed.

The importance of this decision is that by applying the following guidelines, the police officer can greatly increase the likelihood that evidence recovered from a fleeing suspect will be admitted into evidence:

1.Before approaching a suspect, you should have at least a suspicion that criminal activity has happened, is happening, or is about to happen.

2.The level of intrusion must be reasonable in light of the surrounding circumstances. (For example, in the Smith case, had the suspect not fled, there would only have been mere suspicion and a forcible stop would not have been justified.)

3.The level of suspicion may subsequently rise as the encounter progresses. In this case the court recognized that flight can raise mere suspicion to reasonable suspicion.

4.If the level reaches reasonable suspicion, as in this case, you may use force to restrain the suspect.

5.If you have reasonable fear for your own personal safety, then a frisk is permissible.

Criminal negligence occurs when a person fails to be aware of the risks attached to his actions, but should have been so aware, and engages in such actions which produce grave consequences to another. In sum, a person fails to perceive a risk but should have perceived such risk.

Assault in the third degree. A person is guilty of assault in the third degree when:

1.With intent to cause physical injury to another person he causes such injury to such person or a third person; or

2.He recklessly causes physical injury to another person; or

3.With criminal negligence, he causes physical injury to another person by means of a deadly weapon or a dangerous instrument.

Assault in the third degree is a class A misdemeanor.

Assault in the second degree. A person is guilty of assault in the second degree when:

1.With intent to cause serious physical injury to another person, he causes serious physical injury to such person or to a third person; or
