On cross-examination Serotta said it was possible the question about the weight set came during a phone conversation with a different detective after Walter’s arrest, but at the end of the suppression hearing, Judge Stout listed twenty-seven “Findings of Fact.” Number five read: “Five, two detectives contacted Mr. Howard Serotta, owner of Crystal Chandelier, two or three days before the defendant was questioned and asked Mr. Serotta questions about [Ogrod], where he lived and worked. They also inquired about his dog and whether or not he had any weightlifting equipment.” On September 23, 1993, ADA Casey asked Judge Stout to reconsider this finding of fact. “I could strike that,” she said. “That is not really important anyhow.” (Ogrod Suppression hearing, 4:12–13.) It was actually very important.
